Yes, Kalshi is a real, federally regulated exchange: as of October 16, 2026, KalshiEX, LLC is a CFTC-designated contract market (designated November 4, 2020) that reports every trade to the CFTC and pays $1.00 per winning NFL game contract from the official final result. That designation is federal oversight, not a state gaming licence, and on August 28, 2026 the Ninth Circuit, in a preliminary-injunction appeal brought against Nevada gaming regulators, said Kalshi had not shown a likelihood that federal law preempts state gaming regulations as applied to its sports event contracts. Over the 30 days to October 16, 2026, Kalshi's closing game prices sat on average 2.5 points from the devigged sportsbook consensus.

Who regulates Kalshi, and what that covers

The CFTC's press release of November 4, 2020 says it "issued an Order of Designation to KalshiEX LLC, granting it status as a designated contract market (DCM)," finding that KalshiEX "demonstrated its ability to comply with the requirements of the CEA and the CFTC's regulations applicable to DCMs." Kalshi's own documents add:

The designation is not a state gaming licence or a promise about any trade: "Members risk losing their cost to enter any transaction, including fees" (Kalshi fee page).

Will Kalshi pay out on a game?

Kalshi's help centre: "A market settles when the official outcome is confirmed and our markets team finalizes the result." Most markets settle within about 3 hours after the outcome is known, and winning contracts "are paid out to your cash balance."

The NFL game contract (filed with the CFTC February 13, 2026) settles on "the official final result", and "all overtime periods are included". A winner pays "$1.00", "no later than the day after the Expiration Date, unless the Market Outcome is under review pursuant to Rule 7.1." A tie resolves to "$1/(the number of tied teams), rounded down": $0.50 a team at 20-20.

Under Rule 7.1 (Rulebook v1.29, August 17, 2026), the Outcome Review Committee must "determine a final Market Outcome within a 24 hour period after the Outcome Review Process is initiated." "The determinations made by the Outcome Review Committee are final."

What Kalshi costs: the fee formulas

From the fee schedule marked "Last updated and effective: July 7, 2026", both formulas quoted as published:

Taker: fees = round up(M x 0.07 x C x P x (1-P))
M = the multiplier for each contract (default is 1 unless otherwise indicated)

Maker: fees = round up(M x 0.0175 x C x P x (1-P))
M = the multiplier for each contract (default is 0 unless otherwise indicated)

P = the price of a contract in dollars (50 cents is 0.5)
C = the number of contracts being traded
round up = rounds up such that the fee + positionCost is rounded to a centicent

Taker fees apply only to "orders that are immediately matched with orders sitting on the orderbook." Kalshi's own table: one contract at $0.50 pays $0.02, and 100 pay $1.75 (0.07 x 100 x 0.5 x 0.5). So $50 of contracts costs $1.75 in taker fees and pays $100 if it wins, and "There is no settlement fee." The fee is largest at $0.50 and falls to $0.07 per 100 contracts at $0.01 or $0.99.

Maker fees are "only charged when a trade is ultimately executed", and cancelling a resting order is free. With M defaulting to 0, a resting order pays nothing unless its series is listed with maker fees. On October 16, 2026 the NBA, WNBA, NFL and NHL game series are listed that way, at multiplier 1. At $0.50 the formula gives 0.0175 x 100 x 0.25 = $0.4375 per 100 contracts, beside Kalshi's published top of $0.44. For both prediction markets side by side, see Kalshi fees vs Polymarket fees.

Can you use Kalshi where you live?

Kalshi's FAQ says that because it "works like the stock market rather than a casino, it's regulated by the CFTC and federal law", and that "we're subject to federal - not state - laws and regulations." That is Kalshi's position, not settled law.

On August 28, 2026, in KalshiEX, LLC v. Assad et al. (Ninth Circuit No. 25-7516), a case against Nevada gaming regulators, the court's summary reads: "The panel held that the district court did not abuse its discretion in dissolving the preliminary injunction because Kalshi did not show a likelihood that the CEA preempts state gaming regulations as applied to its sports event contracts." The panel "affirmed in part ... and remanded in part".

Kalshi's Member Agreement (October 1, 2026) names only countries as Restricted Jurisdictions, and its App Store listing says "Kalshi products are not available in all jurisdictions." No Kalshi page we read on October 16, 2026 lists states, so we print none.

Does Kalshi price games sensibly? What GhostLeg's data shows

Over the 30 days to October 16, 2026 (moneylines in two-way sports, 425 games), Kalshi's closing price sat on average 2.5 points from the devigged sportsbook consensus: MLB 1.6, NFL 1.8, NHL 2.6, WNBA 4.7 and UFC 5.3. Polymarket averaged 2.3 points. EPL and MLS, three-way markets, are excluded.

Brier scores (lower is closer to the result): Kalshi 0.2220 against the books' 0.2289, Polymarket 0.2247 against 0.2266, gaps under a hundredth. Which venue landed closer splits near even (NFL 50.0% to 50.0%). Neither venue is reliably sharper than the books over 30 days; that is a fact about the venues, not a GhostLeg accuracy claim.

Seattle Seahawks at Denver Broncos, October 15. Denver to win at the close: Kalshi 44%, devigged books 43.5%, Polymarket 43.5%; Pinnacle +128 (43.9% implied), FanDuel +126, DraftKings +130, BetMGM and Bovada +125. Denver won 17-14, with all three venues within half a point.

Buffalo Bills at Los Angeles Rams, October 12. Rams to win: Kalshi 62%, devigged books 64.9%, Polymarket 61.5%. All three made the Rams the favourite, and Buffalo won 37-34: a price is not a promise.

The Signal Board shows these gaps game by game across seven sportsbooks, Kalshi and Polymarket, and Line Shopping compares the books, ungated. Compare the two markets in our Kalshi vs Polymarket breakdown. Programmatic access: GhostLeg's Data API, coming soon.
